College Essay: Driven by my mother’s sacrifices

It was a humid summer day of my fourth year in America when I decided to apply for Advancement Via Individual Determination (AVID) to help me achieve my goal of a college education.

Until I turned 12, I had no hopes, dreams or future. I never imagined myself going to college.

I inhaled a deep breath and checked the “No high school diploma” box for my parents’ education. My mother, a 57-year-old immigrant widow, works every day just to be able to afford a one-bed apartment for a household of four.

On May 9, 2000, I was born in Burma, now known as Myanmar, under the name Naw Saw K Pay Poe. When I turned 2, my dad passed away and life became difficult. I could sense that people looked down on my family because our household leader was no longer a man. Throughout this experience, I felt my mom’s pain, but she never gave up on me. She shows me and everyone around her that she can live without a man.

When I was 5, my family moved to a Thailand refugee camp because my mother wanted greater opportunities for her family. My mom taught me to take advantage of every opportunity that I have. I learned numerous lessons from growing up with my mother. She inspires me through her actions and work ethic.

My school in Thailand was built out of bamboo and there were blackboards instead of smartboards. The school didn’t provide buses, lunch or breakfast. Students were hit with bamboo sticks for not completing assignments as small as memorizing a paragraph.

There were few resources, but it was better than my mother’s education experience. My mom couldn’t afford to pay for school because she had to work each day to survive. In addition, there was limited education due to the long civil war between the Karen and Burmese soldiers.

In the summer of 2012, my family moved to the United States from the Thailand refugee camp, and I became Pay Poe. After moving to the U.S., life became difficult again. It was a new country with new people.

When I arrived at my new school, I had no clue why I was there.

Slowly, I looked up at my tall, smiling teacher and followed her into a room full of my new classmates. I could feel all eyes on me. I was the shortest, smallest and loneliest of all. It felt like I had dropped down into a world where I didn’t belong.

Over time, I learned a lot more about the culture. I knew how to ask for help and began to understand the reasons why my mother left everything and moved to America. I used to go to her and say, “I don’t like school because I don’t have any friends.” She would reassure me and say, “Remember, you don’t need friends to go to school, and we moved here because we want you to be educated.”

My mom’s support and hard work motivate me to value my opportunities. I attend school every day. I’m never late for my classes. I stay organized so there aren’t missing or late assignments. I’m grateful and ready to be the first in my family to attend a university.

Nelson Mandela once said, “Education is the most powerful weapon which you can use to change the world.” I am driven by the sacrifices my mom made so that I can achieve my dreams. People can take away our land, our rights, but they can never take away our knowledge.

I work hard because one day I want to check the “College degree” box for my own education and prove that I can overcome challenges and thrive.

A mother’s sacrifice: tracing the literary history of maternal love

As Toni Morrison's Beloved illustrates, maternal love defies restrictions based on the intersection of race and gender, and exists beyond patriarchal rules of ownership.

What is a “ good mother ” ? One who would sacrifice all for her children. One who offers love that is endless, silent, undemanding, One who would deny her own maternal identity rather than see her offspring rent in two. A good mother is her children; she does not have a story of her own. She is the channel through which others learn to speak.

Sethe – the heroine of Toni Morrison’s Beloved – is not a “ good mother ”. She questions the very conventions of the maternal narrative. An escaped slave in the latter half of the 19th century, she inhabits a world in which “ good mothering ” is highly valued, but only for a certain type of woman: white, wealthy, outsourcing. Sethe’s role is to be passive: produce flesh, produce milk, but whatever you do, do not love. Tie up your child, work, and then watch as others take your compliance as evidence that you were never really human at all.

In his introduction to The Folio Society’s beautifully illustrated reissue of the novel, Russell Banks describes the work as “a story about family life and love, and how, in a social and economic universe designed explicitly to destroy them, they endure.” They endure, but in a haunted, distorted form, an echo of the 28 days during which Sethe can enjoy her children before they are hunted down. Twenty eight days marks the distance between an act of nurturance and one of murder; “the travel of one whole moon […] from the pure clear stream of spit that the little girl dribbled into her face to her oily blood.”

During this short space of time Sethe embraces the dominant values of idealised maternity (“it didn’t matter whether it was real or not”). She behaves in a way that would, for a white heroine, be conventional, but which is, as Andrea O’Reilly puts it , “a radical act of defiance against the prohibition on slave motherhood.”

The illusion is meant to end upon recapture, but it does not, because Sethe refuses to let her family be taken from her. Instead she attempts to kill all four of her children, succeeding with the girl she names Beloved. Sethe’s passion defies the slave owner’s – and the western plotline’s – attempts at appropriation, for better or for worse.

Morrison has famously said of her character’s act, “ it was absolutely the right thing to do, but she had no right to do it ”. It is an act situated in the space between self-assertion and self-sacrifice, where Sethe has taken what is humane and preserved it when faced with all that is inhumane.

Overriding the traditional white feminist opposition of maternity and self-affirmation, it is a an act of rebellion (“I stopped him […] I took and put my babies where they’d be safe”) but one which people within Sethe’s own community regard as untenable (“your love is too thick”, says fellow former slave Paul D). It is seen as prideful, presumptuous, a reversal of the agonised witnessing that is all her mothering is scripted to be.

What struck Morrison about Margaret Garner , the woman whose real-life story provided the initial (if brief) inspiration for Sethe’s, was that much as many of her supporters would have liked her to be insane, her act of infanticide appears to have been firmly rooted in maternal logic:

They kept remarking on the fact that she was not frothing at the mouth, she was not a madwoman, and she kept saying, ‘No, they’re not going to live like that. They will not live the way I have lived.’

This tenaciousness – the powerful affirmation of what is right about an act of maternal violence, within a culture that simultaneously sets ideal standards for mothering while deny black women the right to exemplify them – is echoed by Sethe: “It worked. […] It ain’t my job to know what’s worse. It’s my job to know what is and to keep them away from what I know is terrible. I did that.” Men such as Paul D and Stamp Paid, recasting this as “she was trying to out-hurt the hurter,” understand the position of injustice but not the passion that drives Sethe. And yet if, in a world in which some human beings are treated as the possessions of others, it remains true that we belong to ourselves, mothers cannot under any circumstances take the lives of their children. “She had no right to do it.” And yet.

The maternal crisis faced by women such as Sethe is not simply a fiction nor an anachronism. It remains with us to this day, in other stories, stories which are rarely told. Dominant groups control the reproductive lives – and make judgments over the right to love – of those they whom subjugate. Across the globe, poor women of colour bear the genetic offspring of wealthy white couples, while here in the UK mothers on benefits are told the only acceptable third child must be the product of rape. The options for rebellion are limited.

In Sethe’s act, I am reminded of what is perhaps not a new phenomenon, but something identified as a modern-day cultural trend: the family annihilator , the man who kills his own children and himself so that their mother – the perceived “owner” – cannot have them for herself. With his misplaced sense of grievance, rooted in the patriarchal belief that women’s physical and emotional labour amounts to little more than a calling of the reproductive shots, he appropriates the concepts and language of reproductive justice. As black scholars such as Dorothy Roberts and Patricia Hill Collins have shown, for women of colour the historical legacy of their desire to nurture goes beyond such a crass jealousy. As Hill Collins writes , “slavery was a situation where owners controlled numerous dimensions of [African-American women’s] children’s lives”:

Black children could be sold at will, whipped, or even killed, all without any recourse by their mothers. In such a situation, getting to keep one’s children and raise them accordingly fosters empowerment.

One can debate whether or not there is empowerment in death ( Morrison : “I think if I had seen what she had seen, and knew what was in store, and I felt that there was an afterlife – or even if I felt that there wasn’t – I think I would have done the same thing”) but what is notable is that right now, in a situation of global reproductive deprivation, privileged men parody the injustice that underprivileged women experience, to the extent of feeling it so strongly they commit the acts that these women do not.

While there is a selfishness to all forms of parental self-sacrifice (what we do for “our” children may not be what we would do for the children of other communities), what Beloved articulates so carefully and magically is the double-bind of self-affirming love within the context of oppression: not the fetishised, existing-only-in-one-context love of the white angel of the home, but love as material reality, flowing in water, milk and blood.

There is a gendered and racial context in which asking “what makes a classic?” puts the white andor male critic on a level with Sweet Home’s schoolteacher, with his notebook and pencil and presumed right to classify that which is “human or animal” in others.

In 1994’s In Defence of Elitism William A Henry III was to huffily describe how, “Toni Morrison’s Pulitzer Prize in fiction for Beloved came after an explicitly race-based lobbying campaign on her behalf, with a modicum of feminist pressure thrown in as well.”

That is, we are supposed to think, evidence of bias (because objectivity – in aesthetics, in science, in the evaluation of human worth – is white and male). The blank piece of paper remains a white, male space, so when Morrison writes, it is still a writing-over, a trespass, an offence by default. For white readers like me, our highest praise risks being the pathetic “but I didn’t even notice”. Yet a more careful reading can make the page alien to us, as it should, since this is neither our offspring nor our offering.

In The Mother/Daughter Plot , Marianne Hirsch argues that with Beloved , “Toni Morrison has done more than shift the direction of her own work and of feminist theorizing: she has opened the space for maternal narrative in feminist fiction.”

Much as I am wary of any universalising impulse – we must be clear that there is no maternal narrative, only narratives – I think there is truth in this. Maternal love defies restrictions based on the intersection of race and gender, and exists beyond patriarchal rules of ownership. It exists in flesh and milk, in each maternal body, yet the conditions under which one is asked to love, or not love, vary enormously. Thus in Sethe’s case, there is a desperate need to capture the beauty existing beyond the handsaw and the accusations of pride:

She just flew. Collected every bit of life she had made, all the parts of her that were precious and fine and beautiful, and carried, pushed, dragged them through the veil, out, away, over there where no one could hurt them. Over there. Outside this place, where they would be safe.

Like a ghost child emerging from the water, it alights from the page and is visible. Just there.

The Story of A Mother’s Sacrifice

The story of the two mothers in 1 Kings 3 is often told to highlight the wisdom of Solomon. But there’s another theme playing through the story…one of a mother’s sacrifice.

What it Means to Sacrifice

At its most basic level, sacrifice is giving up something you value for another person. It is “esteeming others better than yourselves” to the point that you choose their happiness or well-being over yours.

The Story of a Mother

The story of the mother’s sacrifice in 1 Kings 3 begins with an encounter between Solomon and God. Solomon had recently ascended to the throne and when God asked what he wanted, he chose wisdom. The story of the two mothers is often used to depict the wisdom of Solomon.

But let’s look at the story again through the eyes of the mother’s sacrifice.

Now two prostitutes came to the king and stood before him. One of them said, “Pardon me, my lord. This woman and I live in the same house, and I had a baby while she was there with me. The third day after my child was born, this woman also had a baby. We were alone; there was no one in the house but the two of us.

“During the night this woman’s son died because she lay on him. So she got up in the middle of the night and took my son from my side while I your servant was asleep. She put him by her breast and put her dead son by my breast. The next morning, I got up to nurse my son—and he was dead! But when I looked at him closely in the morning light, I saw that it wasn’t the son I had borne.”

The other woman said, “No! The living one is my son; the dead one is yours.”

But the first one insisted, “No! The dead one is yours; the living one is mine.” And so they argued before the king.

The king said, “This one says, ‘My son is alive and your son is dead,’ while that one says, ‘No! Your son is dead and mine is alive.’”

Then the king said, “Bring me a sword.” So they brought a sword for the king. He then gave an order: “Cut the living child in two and give half to one and half to the other.”

The woman whose son was alive was deeply moved out of love for her son and said to the king, “Please, my lord, give her the living baby! Don’t kill him!”

But the other said, “Neither I nor you shall have him. Cut him in two!”

Then the king gave his ruling: “Give the living baby to the first woman. Do not kill him; she is his mother” (1 Kings 3 16-27 NIV).

I imagine that the idea of cutting a baby in two seems like a horrible verdict for the young king to pass as these two mothers stood before him. What if they had both agreed? But then, why would anyone agree to such a barbaric and cruel act?

A Mother’s Sacrifice

Yet, we see two responses in this story. One woman eagerly agreed to the king’s suggestion while the other just as quickly rejected it. 1 Kings 3:26 in the King James Version reads “the bowels of the woman yearned for her son”. I don’t know about you, but I have no idea what it means for bowels to yearn. Do bowels even know how to yearn? Let’s go back to the original language and see if we can figure it out.

The Hebrew word for bowels is racham . It could also have been translated as womb, compassion, mercy, or pity. The word translated as yearn is the Hebrew kamar . Another way of translating it could have been “grow warm and tender” or “become emotionally agitated”. I almost get the feeling that the woman’s womb twinged when she thought about the child she had labored to bring into the world being cut in two.

She couldn’t let that happen. She couldn’t let anything happen to her innocent child. She would rather live without him than have to live with the idea that he was dead. She was willing to make the ultimate sacrifice for her child: she would give him to the other woman if it meant his life would be spared.

The Greatest Sacrifice of All Times

This mother’s sacrifice reminds me of the sacrifice Jesus and our Heavenly Father made on our behalf. Long before you and I were born, God knew we would sin. He knew the consequence of sin was death–eternal death. But rather than trying to find ways for us not to sin, our Heavenly Father put a plan in place. He would send his son–his perfect son–to die in our place. We would have the chance to live and be reconciled with him.

Jesus also had a choice in his sacrifice. He didn’t have to agree to the plan to die in the place of sinful human beings who chose to disobey God’s command. But he did. He chose to make that sacrifice and to put himself in our place because he loved us. Just as that woman loved her son enough to live without him, God loves us enough to die in our place.

The Sacrifices of a Mother

As mothers, there are many things we would do for our children. I’m sure if I asked you what you would sacrifice for your child I would get a long list of the things you’ve already done and

will continue to do for your child. I want you to you right now, mother, whether you have biological children or just darlings of your heart, our Heavenly Father sees your sacrifice. He sees the things you do to safeguard the welfare of your child. He knows just how far you would go to protect your children.

But I want to implore you, sweet mother, do not sacrifice your relationship with God for your children. I encourage you to remind them of the greatest sacrifice that was made on all our behalf. I pray that through your sacrifices you remind them of the greatest love story ever told. I pray that your mother’s sacrifice will be a tale of love and forgiveness. I pray that like the woman in 1 Kings, the story of your mother’s sacrifice will be told long after you no longer walk the earth.

Unless you are full, you cannot feed the hungry. Unless you are strong, you cannot help the weak. Unless you are taken care of, you cannot look after the needs of others. You cannot give what you do not have, or so I thought.

Going back to Manila the day after visiting the tombs of my grandparents during All Souls' Day, one woman sat across me on a P2P bus. She was with her two children, a boy who was around 3 years old, and an infant carefully wrapped in her arms. The baby immediately cried the moment they settled in their seats, and the little boy was of no help — he was in a fit of anger over something he couldn't get.

The woman was flustered. She accidentally dropped the cap of the baby's feeding bottle as she hurriedly pulled it from her bag to tame the wailing and fussy infant. The discomfort of the older child, on the other hand, eventually stopped after a little while. She handed him a biscuit and told him that it was the last piece, so he had to be careful not to drop it.

Then there was silence. All I heard was the sound of the baby getting good mouthfuls of milk seconds after the disorder. Not too long, the toddler asked his mom some questions. As the women tried to answer them the best she can, I could not keep myself from eavesdropping despite feeling drowsy and my eyes being half asleep.

In their conversation, I found out that the mom and her kids came from her husband's tomb. From the sound of it, he just passed away recently. As if she was talking to an adult, the mom narrated to the little boy the struggles she now faced every single day in coping with the loss and how she planned to raise them.

She assured the boy's good future, howeverm, and it warmed my heart. All I could hear was an affection of a mother's love in spite of her sad situation. What I perceived to be a pitiful story ended up to be an inspiring one.

The boy offered the last portion of the biscuit when he heard her mother's tummy acting up. Still, the mother refused and told him to finish it, telling him that she'll eat something later instead.

"Isusubo mo na lang, ibibigay mo pa." This is, by far, the most selfless act a mother can do to show her love for her children. I am grateful I have one.

Unless you are inspired, you cannot give inspiration to others. Unless you are motivated, you cannot motivate others. Unless you are loved, you cannot show love to others. I used to believe in the saying that you cannot give what you do not have. That is until I met this woman and reminded myself that a mother's love is different.

You can inspire others, motivate others and show some love to others regardless of your circumstances. You can actually offer something even if you are lacking — you can actually give even if you do not have.

SHE is in charge of groceries, kitchen, household concerns and budgeting funds for the entire family.

She is the first person to sacrifice her life by giving birth to all of us children. She taught us how to walk, talk and smile. Our first mentor and teacher in helping us determine what is right and wrong. That is how our mothers are!

Some moms, especially in our new generation evolve as the sole providers of the family.

Many are saying that mothers are the emotional backbones of the family. If problems occur they are the strongest person to hold back and we can always rely on them; help us when we are undergoing certain emotional or physical problems along the way in the challenges of life. My mother is always with us all the time. She became our mother and father at the same time when my father passed away when I was only 3 years old. I considered her attitude as extraordinary and special, as she raised us her 3 children’s as a provider and a full-time mom. I would like also to acknowledge my Lola and special aunt, the only sister of my mother for also being role models in our growing period.

“For any teenager, regardless of the family situation, you get to a certain age and there is this need to rebel in a certain sense,” Sink said in a Zoom interview.

“For Mazzy, because her relationship with her parents is so strained, she feels she’s a casualty of their relationship and not being paid attention to or really understood.

“On top of that coming of age point where you want to figure out yourself and experiment with new things, she maybe makes a less than smart decision.”

Dating the first Berlin guy she meets is, Sink said, “A direct shot at her dad. It’s ‘I’m going to do this. And I hope he finds out.’

“She wants to be a little bit selfish after being in a dynamic where she feels she has no say or no control over anything.”

The cult is super-controlling and scary, homicidal even. That sense of Gothic horror was a draw for Sink.

“First, what attracted me — it was such a challenge physically and then the emotional stamina required in the ending.

“At the time, I was super into the idea of cults and would find myself frequently on these YouTube rabbit holes of all sorts of horrible, creepy things.

“So I had a casual interest in the idea. And I was a fan of this script — it read as if I’d been given a novel. Then the idea of Berlin was super exciting.

“To go film in a foreign city and be able to connect with the character in that way. She’s discovering Berlin — and I also would be there living in a new city on my own. Finding my own routine and sense of purpose in a new environment.

“It definitely was a challenge. I was thinking about this earlier today. Like, when you read the script for these action sequences at the end, it makes sense and you’re on the edge of your seat reading it.

“Then you actually have to do it! You’re like, ‘Wait a minute, this is a lot more difficult than I thought!’

“But I’m so glad I went through all of it. Because the stamina it required, it definitely taught me a lot.”

Parents failing to submit tax returns are skewing child support payments

More than 160,000 parents in Australia's child support system failed to lodge tax returns last financial year and avoided paying or receiving the correct amount in child maintenance payments from their ex-partner.

Experts warned that failing to lodge a tax return was a common tactic used by parents to avoid paying their full child support obligations and should be recognised as a form of economic abuse.

Figures obtained by the ABC show Services Australia, which administers the child support scheme, referred 168,082 parents to the Australian Tax Office (ATO) in 2022-23 for having overdue tax returns.

Government data showed there were more than 651,465 parents in the child support system, meaning a substantial proportion of returns could be outstanding.

According to Services Australia's figures just over three-quarters of child support parents were active paying parents without a debt.

Services Australia use tax returns to assess separated parents' income and work out how much child support they must pay.

The ATO can also use money from a parent's tax returns to pay any outstanding child support debts owed to the other parent.

If a parent doesn't file a return, their income is estimated based on either their last tax return, adjusted for inflation, or two-thirds of the male total average weekly earnings, whichever is higher.

Experts said parents often used this strategy to pay less in child support than they would if they declared their true income.

The impact can be devastating, according to Women's Legal Services Australia Executive Officer Lara Freidin.

"Australia has failed to recognise and respond to the link between non-payment of child support and economic abuse as a form of family violence," she said.

"It's a continuing form of violence."

Ms Freidin said non-compliance had a profound impact on women who made up 83.4 per cent of child support recipients and were already facing significant economic disadvantage.

Multiple tactics used to avoid payment

Women's Legal Services recently conducted a literature review looking at non-payment of child support that drew on academic works, government inquiries and data, media, policy papers and reports from frontline workers.

It found reports of parents avoiding child support by doing cash-in-hand work, salary sacrificing, setting up business structures, lodging tax returns late and using superannuation and trusts.

"Coupled with inadequate enforcement from Services Australia, the onus falls on the mother to contact Services Australia to initiate an investigation or court proceedings," Ms Freidin said.

Of the outstanding returns, the ATO said in 2022-23 its enforcement program led to 73,426 tax returns being lodged and 21,038 child support debts recovered.

An ATO spokesperson told the ABC where returns were ultimately lodged, some clients' earnings didn't qualify for a tax refund and therefore no debts could be recovered.

Barrister Catherine Devine deals with some of the most complex child support cases and said the failure to lodge tax returns was far more common than people realised.

She said there could be many reasons why people didn't lodge, ranging from mental health issues to poor literacy, while others were hiding their real income to lower the amount owed to their ex.

"Cash is a huge problem, particularly for tradespeople it is a big problem."

The Women's Legal Services review found there was even a website where paying parents were advised how to legally minimise their taxable income to reduce child support payments.

"The non-payment or underpayment of child support is enabled by a system that tends to take a hands-off approach, giving fathers an undesirable amount of control," the review stated.

'The numbers don't stack up'

Legally, the ABC can't identify people involved in family law proceedings so we have used a pseudonym to hide their identifies.

Timothy, a Victorian father-of-three who pays $900 a fortnight in child support and regularly submits a tax return, said his ex-wife hadn't submitted a tax return for four years.

"I have always provided for my family. This has often come at the detriment to my health and wellbeing," he said.

His ex-wife recently gave Services Australia a provisional income estimate of $11,000 — which increased his child support payments.

And while Timothy thinks that's not accurate, it falls under the threshold that would have legally required her to submit a tax return.

"The numbers she's providing don't stack up. There's no way she could buy me out of a house, pay its mortgage and pay private school fees on $11,000 a year, it's just not possible."

He suspected his ex-partner received cash-in-hand from a family business.

Timothy said he'd like to see payments held by Services Australia until tax returns were submitted.

Father suspected of hiding money offshore

Mother-of-one Yvette said she'd like to see more than just taxable income used as a measure to calculate child support.

She believes her ex-husband should be paying her child support, but instead, based on their taxable incomes, she has to pay him $2,000 a year.

She suspects he hides his real income in his business and she recently learned he'd purchased valuable real estate in his business's name.

"The system needs to fairly account for parents that are business owners and can hide cash," she said.

"He doesn't need money from me. This is just another way to perpetuate financial abuse that was already there in the marriage," she said.

Ms Devine said there were rules to help parents who wanted to appeal payments and the government had power to investigate unexplained wealth, using businesses to hide funds, or poorly-disclosed changes to income.

Timothy said he'd started this process but had found it too complex.

As the government's wider review of child support continues, Women's Legal Services Australia is calling for a series of urgent reforms, including better enforcement of deadlines for lodging tax returns.

It also called for the government to provide a child support guarantee, meaning the government would cover any amounts not paid by ex-partners.

Ms Freidin said more funding was also needed for Legal Aid services to help women appealing child support income assessments.

Collecting small sums of money costly

Another challenge was recouping what was often relatively small sums of money, with ATO data showing the average amount it clawed back for child support debts was $1,709 per return.

The table below from a 2017 audit shows how many people owed these small amounts.

Services Australia said the 168,000 parents referred to the ATO included anyone who had not lodged a return in the past five years, were referred multiple years in a row or had historical debts.

In a statement an ATO spokesperson said in the second six months of 2023 it made almost 1.5 million attempts via texts, emails, letters, and phone calls to contact taxpayers with outstanding returns who had child support debts.

In the recent federal budget the government allocated $5.1 million for a series of reforms including reviewing compliance in the child support scheme, with a focus on collection and enforcement.

In Jenni Rivera’s rise from Long Beach teen mother to icon of regional Mexican music, family was a constant. She titled her first album Somos Rivera — We are Rivera. It was released in 1992 on a label her parents started in their garage.

Her five children were the center of her life on stage and off. Their antics and affection on the reality show “I Love Jenni,” broadcast on Telemundo’s Mun2 channel, had the vibe of Spanglish-speaking Kardashians.

Nearly a dozen years after Rivera perished in a plane crash in Mexico, her tracks about wild nights, strong women and heartbreaking men remain popular. But the relatives who accompanied her on the journey to superstardom are now waging familial warfare.

Her children have accused their grandfather, Pedro, a Latin music legend in his own right, and an aunt and uncle of misappropriating part of their inheritance. They have alleged the trio plotted to siphon off funds from Rivera’s estate, once estimated at $28 million, in a decade-long scheme they say preyed upon their grief and industry inexperience.

“This matter provides a perfect illustration of the significant and lasting impact that money, power, and greed can have on a family,” the children’s attorneys wrote last year in a federal lawsuit against companies controlled by their grandfather.

Pedro has denied wrongdoing by him or his children. His attorney blasted the younger generation in a February court filing as having “despicably tossed aside their own grandfather.” Their decision to air the family’s laundry in court, the lawyer wrote, “will exist forever as a stain on the legacy of Jenni and the Rivera family.”

Tales of families battling over the estates of dead celebrities are common in Hollywood. Think Michael Jackson, Jimi Hendrix, James Brown. But the Rivera clash stands apart because it’s playing out within a family — and a culture — that has held blood relations as sacred.

Fans who saw themselves in Rivera’s story of struggle and sacrifice have attacked her children on social media as “ mezquinos y sin corazon ” — petty and heartless — and “ egoístas, ” selfish.

“They knew they were going to be called all kinds of names,” said Laura Lucio, Rivera’s longtime friend and producer. “This is the Latino community, where grandpas and grandmas are respected and whatever they say goes.”

Rivera died on Dec. 9, 2012, at the age of 43 as she and her entourage flew from a concert in Monterrey, Mexico, to a television taping near Mexico City. The Learjet plummeted more than 28,000 feet and crashed into mountainous terrain, killing all seven aboard.

At the time, Rivera’s children ranged from 11 to 27 years old. Her eldest, Janney Marin, known as Chiquis, had long been her heir apparent. Rivera gave birth to Chiquis at 15, and they often seemed more like friends than mother and daughter.

But in a twist worthy of a telenovela, Rivera disinherited Chiquis just two months before her death. The singer suspected her daughter of having an affair with her third husband, former Major League Baseball all-star pitcher Esteban Loaiza, after reviewing security footage that supposedly showed them alone in a walk-in closet for 39 minutes. Chiquis denied any liaison.

As a result of their rift, Rivera left everything to her four younger children and named her then-31-year-old sister Rosie, who had worked as an insurance adjuster, to run her estate. To aid her, Rosie tapped their brother Juan, a 34-year-old singer and aspiring producer who had struggled with addiction for years.

“We’re talking about two people who had no real business experience, so it was like training rookies for an impending professional game,” recalled Rivera’s onetime manager, Pete Salgado, in a 2017 book, “Her Name Was Dolores,” one of a half dozen memoirs published by family and friends after Rivera’s death.

The siblings were steering an estate that was worth between $28 million and $30 million at the time of her death, according to Lucio, Rivera’s friend and producer. Over the years, the singer’s empire has included TV programs, a fashion line, radio show, fragrances, beauty products, real estate, a tequila enterprise and, of course, music.

Rivera had released more than 20 albums and sold at least 15 million records during her career. In death, she continues to draw fans. More than 11 years after the crash, her music still attracts 4.8 million monthly listeners on Spotify.

Her second-oldest child, Jacquelin Campos, known as Jacqie, was 23 at the time of her mother’s death. Jacqie was given a job with the estate, but she and her siblings have suggested she had no real power. In their federal lawsuit, the children allege that their grandfather, aunt and uncle discouraged their involvement in the business, telling them “to focus on building their own lives.”

They were reeling in the years after their mother’s death. Chiquis and Trinidad, then 21 and known as Mikey, contemplated suicide, according to declarations filed in the estate’s lawsuit against the owner of the plane and other entities. Jenicka, who was 15, left her public high school to avoid classmates’ stares and pity.

“[E]veryone knew me as Jenni Rivera’s daughter and knew how emotionally distraught I was,” Jenicka wrote in her 2017 declaration. “I was uncomfortable there and didn’t want anyone to see the pain I was going through.”

Then there was the baby of the family, Juan Angel Lopez, known as Johnny, just 11 at the time of his mother’s death. He was particularly close to Rivera, who called him “my little soldier” and liked to say he had a savviness that dated back to the womb.

She sought an abortion when she became pregnant with him in 2000, but a doctor could not initially locate the fetus, she said in her memoir, “Unbreakable,” and on the “I Love Jenni” show. On a second visit, the doctor found it, but Rivera decided to have the child, recalling on the show, “This is going to be a special boy, he doesn’t want to die.”

As a child, he had a sharp mind, finishing high school in two years. He also had a clear interest in the music business. Lucio recalled him asking his mother when he was in elementary school to explain the different jobs in the studio and who got what cut of the profits.

Publicly, the family rallied around Johnny after his mother’s death. Pedro referred to the boy as “the most affected” by her loss in a 2018 declaration in the plane litigation. But privately, his aunt, uncle and grandfather were plotting against Johnny and his siblings, according to their suit.

An employee at Pedro’s record label, Cintas Acuario, told the children years later that she overheard the trio hatching a plan about a month after Rivera’s death to steal from the estate by funneling money to the label. Rivera’s brother told Rosie and Pedro they could get away with it because most of the kids were “stupid children” with no grounding in the business, the suit claims.

“The only one of the beneficiaries who would ever be capable of catching on was … Johnny,” the suit quotes Juan as saying. He “specifically referred to Johnny as a ‘cabrón’” — sometimes translated as bastard — “who the perpetrators of the scheme would have to be cautious of in the future.”

The older Riveras deny the conversation ever occurred and accuse the employee, Fabiola Avalos, of making up the story after she lost a sexual harassment case against Pedro. Avalos confirmed to The Times that she overheard the conversation, but declined further comment.

Juan said in an interview that he was flabbergasted by the allegation, saying, “Where did I go so wrong as a human that they could believe that from me?”

If there were concerns Johnny might cause problems for his aunt, uncle and grandfather, they were prescient. At age 16, the boy started asking for a financial accounting of his portion of the estate. Chiquis, who was his guardian, told him to wait, recalling in “Unstoppable,” one of two memoirs she has published, “I didn’t think it was a good idea to upset the family.”

He asked again at 18, Chiquis wrote, and was again told no. When he was 20, she wrote, “he brought it up again and I asked him to sit on it and pray. He did and was resolute with his decision…”

Johnny’s persistence set the stage for a showdown between two very different branches of la familia Rivera .

As her star rose, Rivera was able to give her children a comfortable life, first in a Corona mansion and then in a four-acre Encino estate later sold to television personalities Vanessa and Nick Lachey.

It was a far more luxe upbringing than she and her five siblings had. Her parents emigrated from Sonora in the 1960s. Her father picked grapes in the Central Valley for a time. The family bounced around L.A., dodging evictions, until finally buying a two-bedroom home on Gale Avenue in a part of Long Beach then plagued with gangs.

The Riveras loved corridos, a genre of Mexican ballads about drug trafficking, government corruption and other gritty topics, and sold CDs and cassettes at the Paramount swap meet before launching Cintas Acuario in the late 1980s.

The label’s marquee act initially was the pioneering Mexican singer-songwriter Chalino Sanchez and later Rivera’s younger brother Lupillo. The intense focus on her sibling frustrated Rivera, who recalled in her memoir how she drove her cassettes from one Spanish-language radio station to another trying to get airplay.

She was 30 with four kids and a real estate job in Compton before she had her first hit, “Las Malandrinas , ” a brass-heavy corrido with an unconventional subject, hard-drinking, rule-breaking women.

In the decade that followed, her career exploded, eclipsing Lupillo and other Cintas acts. She racked up accomplishments, from selling out venues such as the since-demolished Gibson Amphitheater and Staples Center to starring in a popular cable show and inking a sitcom deal with ABC.

It was an adjustment for her father, who called himself “El Patriarca del Corrido” — “The Patriarch of Corridos” — but had limited experience with mainstream success. Lucio recalled that, long after Rivera made it big, Pedro was still showing up in the parking lot of her concerts to sell cassettes and CDs from the trunk of his car.

Her family leaned on her for money as her star rose. After her parents’ marriage faltered in 2007, she supported her mother, Rosa, and poured money into their struggling record label. Rivera eventually owned 50% of Cintas, her mother wrote in 2010 divorce papers. Her father acknowledged in a filing the same year a $100,000 loan from their daughter to run the business. She gave to other relatives too.

“There were circumstances where she felt frustrated because she felt regardless of how much she gave them, it was never enough, and she wasn’t appreciated,” Lucio said. Lucio and the estate became enmeshed in litigation over work she did writing the singer’s memoir. They reached a settlement in 2015 before trial.

Rivera became increasingly bitter about the handouts, according to Chiquis, who in her memoir recalled her mother saying the year before her death, “All I am to my family is money.”

Her passing was an emotional blow to her parents and siblings, but also a potential windfall. Her former manager, Salgado, who died in 2020, recalled in his book that her family started discussing plans for a 52-date show called “the Rivera Dynasty Tour” before the singer’s body had even been returned from Mexico.

“I honestly thought I would find a family in mourning, torn and heartbroken by this tragedy, lost and overwhelmed by the circumstances,” Salgado wrote in his memoir of a meeting a few days after the plane crash. “Instead, I found a family trying to figure out how to make their next buck.”

Juan called the account a lie. Rivera’s sister Rosie and her father, Pedro, did not respond to requests for interviews relayed through their lawyer. Rosie wrote in a 2016 memoir, “My Broken Pieces,” that in managing her sister’s affairs, the children were “my number one priority.”

In an interview, Juan said Rosie ran the estate so frugally that she almost fired a nanny who treated herself to an energy drink on the family dime, telling the woman Rivera “did not die so you could buy yourself Red Bulls.”

In another business, in another family, the audit Johnny demanded might have played out in secret. But this was the Riveras.

Jenni Rivera was famous for making her private life public, singing and speaking about single motherhood, domestic violence, weight battles and infidelity. Her survivors picked up her mantle and spilled out their feud on social media.

“He is waiting for more money to continue spending,” Johnny’s grandmother, Rosa, chided on YouTube in June 2021. She added of her grandchildren, “They haven’t worked as they should, the ones who have worked are my children, Rosie and Juan.”

Rosie wept uncontrollably in her own YouTube video, saying, “The kids know I didn’t steal and that makes it worse.”

Chiquis revealed on Instagram in January 2022 — she currently has nearly 6 million followers — that “someone really close to Rosie” had made off with around $80,000 from the estate. (Rosie acknowledged to a Mexican morning show that, years earlier, her husband took money to feed a gambling problem and she repaid it.)

Around that time, Rosie announced she was handing over control of the estate to her niece Jacqie, Rivera’s second child and Johnny’s sister. A news release suggested a peaceful transfer, stating that the audit had turned up “no evidence of any crime, misappropriation or theft of fiduciary funds by Rosie.”

The children’s lawyer would subsequently say in court that the pleasant tone was just a way to free an estate that “was essentially being held captive” by Rosie and Juan.

Their questions about the financial management remained, so the children dispatched Jacqie to get answers from their grandfather. What happened at the meeting depends on whom you ask.

Pedro asked Jacqie “for a plan, a strategy of what they wanted to do,” Juan said in an interview. “She told him she’d get back to him within a week with a breakdown.”

Juan said she never did.

Lucio, Rivera’s friend and producer, said in an interview that she has talked with the children and they told her Pedro refused to answer questions about estate business.

“He was not helpful,” Lucio said. She said Jacqie told her siblings, “We’re gonna have to file a lawsuit because we’re not getting straight answers.”

The lawsuit brought in September by the children on behalf of Rivera’s estate accused Cintas Acuario and another company controlled by Pedro of copyright infringement, trademark violations, breach of contract, fraudulent concealment and other claims. It demanded an accounting and an unspecified amount of money.

The suit noted that Cintas had not regularly paid royalties or complied with contracts that required quarterly accounting statements to the children. John Begakis, a lawyer for Pedro’s companies, confirmed that royalties were not paid for a decade, but asserted in an interview that it was because the labels had discovered Rivera had been overpaid in previous years and was trying to recoup that money. He wrote in a court filing this spring that the estate still owes about $775,000 to one of Pedro’s companies.

Rivera still looms large in L.A. She is set to receive a star on the Hollywood Walk of Fame later this month. People continue to pose for photos at murals dedicated to her. One at Jenni Rivera Memorial Park in Long Beach recaps her struggles: “She was expected to fail and give up. She persevered and fought for her children.”

At Coachella in April, the megastar Peso Pluma paid tribute to the Mexican music icons who came before him. Rivera was one of them. As her face flashed onto a screen on the stage, her son Johnny, who was in the audience, hooted and screamed, “That’s my mama!”

Court proceedings offered little of that joy. More than a dozen reporters from Spanish language news outlets — including Telemundo and Univision — gathered outside the federal courthouse in February, awaiting the outcome of a motion to dismiss the case.

A bailiff checked to make sure everyone stayed off their phones, an adjustment for the terminally online Rivera family gathered inside. Rivera’s children, some dressed in black, squeezed together on a bench in the packed courtroom. Across the aisle, their uncle Juan fidgeted in his seat.

The attorney for Pedro’s companies tried unsuccessfully to persuade a judge to dismiss the case, saying the children had waited too long to complain about the lack of royalty payments and statements.

“They’ve sat back and have not been paying attention,” Begakis said.

As U.S. District Judge Stanley Blumenfeld Jr. referenced the allegations of an orchestrated effort by blood relatives to conceal violations, Rivera’s daughter Jenicka gave a tight smile. The parties were to begin preparing for trial — one set to unfold next year.

When they exited the courtroom, Rivera’s children veered right, while Juan turned left. Rivera’s brother told the swarm of reporters waiting outside that he felt “nothing” upon seeing his nieces and nephews.

“I believe that family ties no longer count in this case,” said Juan, who wore a baseball cap with a cross that overlaid the word “Chosen.”

As the children exited the courthouse, a ripple of excitement ran through the security line and people began calling out to them.

One woman shouted, “We love you, Jenni.”

Mejia was a Pulitzer Prize finalist in 2021 in local reporting for her investigation with colleague Jack Dolan that exposed failures in Los Angeles County’s safety-net healthcare system that resulted in months-long wait times for patients, including some who died before getting appointments with specialists. She joined The Times in 2014.

Harriet Ryan is an investigative reporter for the Los Angeles Times. Since joining the paper in 2008, she has written about high-profile people, including Phil Spector, Michael Jackson and Tom Girardi, and institutions, including USC, the State Bar of California, the Catholic Church, the Kabbalah Centre and Purdue Pharma, the manufacturer of OxyContin. Ryan won the Pulitzer Prize for Investigative Reporting with colleagues Matt Hamilton and Paul Pringle in 2019. She and Hamilton won the Collier Prize for State Government Accountability in 2023. She previously worked at Court TV and the Asbury Park Press. She is a graduate of Columbia University.

On this day in 1944, the liberation of Western Europe began with immense sacrifice. In a tribute delivered 40 years later from a Normandy cliff, President Ronald Reagan reminded us that “the boys of Pointe du Hoc” were “heroes who helped end a war.” That last detail is worth some reflection because we are in danger of forgetting why it matters.

American soldiers, sailors, airmen and Marines joined allies and took the fight to the Axis powers not as a first instinct, but as a last resort. They ended a war that the free world’s inaction had left them no choice but to fight.

Generations have taken pride in the triumph of the West’s wartime bravery and ingenuity, from the assembly lines to the front lines. We reflect less often on the fact that the world was plunged into war, and millions of innocents died, because European powers and the United States met the rise of a militant authoritarian with appeasement or naïve neglect in the first place.

We forget how influential isolationists persuaded millions of Americans that the fate of allies and partners mattered little to our own security and prosperity. We gloss over the powerful political forces that downplayed growing danger, resisted providing assistance to allies and partners, and tried to limit America’s ability to defend its national interests.

Of course, Americans heard much less from our disgraced isolationists after the attack on Pearl Harbor.

Today, America and our allies face some of the gravest threats to our security since Axis forces marched across Europe and the Pacific. And as these threats grow, some of the same forces that hampered our response in the 1930s have re-emerged.
