Administrative leave — also known as home assignment — temporarily relieves an employee of their normal job responsibilities. The employee is asked to remain at home during regular work hours but continues to receive regular pay and benefits.

This type of leave is rarely used and only in situations when an employee should not remain in the workplace. Common reasons for administrative leave include:

  • To secure particularly sensitive information or resources if warranted by the circumstances
  • To investigate allegations of misconduct, which, if true, could place people or University resources in jeopardy
  • To remove an employee from the workplace who is behaving disruptively (pending an assessment of the situation)

Requesting administrative leave

Supervisors who believe there may be a need for administrative leave should speak with their HR consultant. The HR consultant can help evaluate the situation, determine the best course of action, and obtain the necessary approval, as needed.

The vice president of Human Resources, or the vice president’s designee, must approve the leave prior to sending the employee home.

For many companies, a leave policy consists of letting their employees know about their paid leave days and the national holidays they get. But, leave policies are more important than you’d realize. One of the first questions from most candidates who are being recruited by a company is about the organization’s leave policy. Besides the number of leaves, potential employees also want to know the types of leaves that the company has provided, for different needs and emergencies that the employee has.

In this article, we’re looking into the 10 types of leave of absence every company must provide its employees.

Why You Need a Leave Policy in Your Company

A leave policy helps you define the number of leaves your employees have, the types of leaves that they are eligible for, and how to apply for leaves. With a leave policy, you can give them assurance that you will provide them with the essential time off to take care of any issues they have or take time off to vacation, recover from an illness, celebrate their festivals, deal with life events, or simply relax.

Here are 10 types of leaves you need to accommodate within your leave policy:

1. Sick leave

Sick leave is time off given by the company to allow employees to recover from an illness and take care of their health. Sick leaves are crucial to allow employees to get the rest they need without worrying about losing pay. Sick leave is a mandatory requirement in many countries to ensure the well-being of the employee. 

Companies must provide 15 days of sick leave in a year to their employees. However, you must also be flexible with your sick leaves and allow employees to take longer ones if they have severe health issues. 

In many companies, any sick leaves that have not been taken by the end of the year can be carried forward to the next year. However, it’s important you ask your employees to take the day off if they are sick.

2. Casual leave

Casual leave is taken by an employee for travel, vacation, rest, and family events. Such leaves are given to allow the employee to take time off for any life events they have like traveling to another country or weddings they have to attend. Giving the employee paid casual leave will allow them to prioritize their private life when required, making them feel appreciated in the company.

In most companies, employees can take a maximum of 8 to 15 days of casual leave in a year.

3. Public holiday

Public holidays are days that are given as leave by the government. Such holidays must be observed by every institution— schools, banks, government offices, and even private companies. Public holidays include Independence Day, Memorial Day, Labor Day, bank holidays and any nationally-recognized day like the death of a prominent leader of the country.

Include these leaves within your leave policy by looking into the holidays that your government has mandated for your country.

4. Religious holidays

Christmas, Eid, Easter, Holi, Yom Kippur— your employee is sure to place importance on religious holidays that they celebrate and would want the day off to spend time with their family and observe the festival. It’s important that you accommodate these holidays they have by providing them with the option to take leave on the day of the festival. 

Take note of every religious holiday from resources online and ask employees to send a message to you every year, listing the religious holidays that they want time off for.

5. Maternity leave

From taking care of the newborn to recovering from the delivery, maternity leave is an important time for new mothers. Ensure you have accommodated this type of leave in your policy to help employees to not worry about their work while they are busy with their newborn. 

Maternity leave is provided to the new mother for a period of 7 to 17 weeks, depending on the country that the company is based. Ideally, 14 weeks is a good amount of time to be given to the mother, allowing them to take care of their newborn for the first 3 months.

You should also be open to providing extra leave days in case of any postnatal complications.

6. Paternity leave

Paternity leave is granted to new fathers—  husbands or partners of a pregnant woman, surrogate parent, or someone who adopted a child— to take care of their newborns without any worry.

Unlike maternity leaves, new fathers usually get 2 weeks of leave to take care of their child post-delivery. Some countries mandate 1 to 2 weeks of paternity leave for new fathers.

Companies rarely provide paternity leave for the birth of their child since such leaves are not mandatory by law. However, it is important that HRs recognize the stresses of adjusting to the newborn and taking care of the child in their first few days. 

7. Bereavement leave

Losing a loved one is an unavoidable situation and in such events, employees take sudden leave. As HR, you need to have a bereavement leave policy that provides the employee with the time to grieve their loss, manage any responsibilities they may have due to the death, and allow them to ask for a bereavement leave without any hassle.

8. Compensatory leave

Employees who have clocked in more hours than they were required to can be eligible for compensatory days off. Ensure that any employee who has put more time in or come to work on days they were off (like Saturday) are given a compensatory day off or “comp off”.

Compensatory time-off must be automatically recorded within your backend and employees must be informed that they have an extra day of leave for the time they put in.

9. Sabbatical leave

Simply put, sabbatical leaves are “a break from work” where employees can pursue interests they have or take time off for physical and mental health reasons. Unlike other leaves, sabbaticals are long leave periods, from six months to a year. Sabbaticals are commonly taken by employees at educational institutions where professors may want to take a break from their teaching role to do research on their projects. 

Companies whose employees have served them for more than 3 years often give these employees a sabbatical leave to reward them for their loyalty and hard work.

10. Unpaid Leave (or leave without pay)

Now, if your employee has exceeded the number of leaves they were eligible for and are taking a leave that doesn’t fall under special leaves like maternity or bereavement leave, they can still take a leave with a pay cut. Any leaves taken in the year outside of the paid leaves will result in a pay cut for the employee. Ensure that you’ve made clear the number of leaves the employee has and let them know how much pay is cut per leave day they take outside their eligible leaves.

Note: Companies with an unlimited leave policy don’t have to define unpaid leaves. However, you should be able to track and ensure employees aren’t taking advantage of your policy.

Leave is the time that employees take off work during otherwise normal working hours which they are entitled to, by law, or by contract. The thing to know is that leave comes in various forms and various levels of entitlement.

It depends on the company! Companies can determine how generous they want to be with types of leave — but they must also provide the minimum requirements required by law.

Some companies may choose to offer additional types of leave as part of their employee benefits , which can be a great incentive for employees. Sometimes, employees are given additional leave after having worked for the company for some time (an incentive for loyalty).

What Are The Main Types Of Leave?

Annual Leave (Holiday Entitlement)

A set amount of time an employee is legally entitled to leave work.

Bank Holidays

A day off denoted by a holiday (whether on the day or carried over from the weekend).

Casual Leave

A general term including all holidays or annual leave, other than mandatory/legally-defined or statutory leave.

Compassionate Leave (Bereavement Leave)

Leave for an employee to accommodate the loss of a family member (or other emergencies/life changes).

Duvet Day

A day afforded to employees for them to rest and relax (maybe also referred to as a self-care or mental health day).

Gardening Leave

Leave taken when an employee quits and their employer doesn't want them to return to work during their notice period.

Maternity Leave (Parental Leave)

Leave that occurs when a family has a newborn child (leave taken either before or after the birth, or both).

Paid Time Off (PTO)

As part of statutory leave, this is leave that is compensated with pay as though the employee worked as normal.

Sabbatical Leave

A leave type where an employee can take time off to pursue a passion, volunteer, or partake in some kind of project.

Sick Leave

Leave that is taken when an employee falls ill, whether for a day, weeks, or months depending on the severity of the illness.

Time Off In Lieu (TOIL) Leave

Giving people time off for extra work that they’ve done (above their contracted hours).

Unpaid Leave

Employees can take unpaid leave, which can be deducted from their salary if they have run out of other types of leave.

Miscellaneous Leave

All other forms of leave that may not fit in the above list are classified as miscellaneous leave.

Annual Leave (Holiday Entitlement)

In the UK, employees are entitled to 5.6 weeks of paid holiday each year, pro-rata, including bank holidays. The more hours they work, the more holidays they are entitled to. Workers also earn holiday pay while on furlough. However, people in the UK cannot be paid out for leave unless they leave their job.

Bank Holidays

The UK has approximately eight public or bank holidays each year. Occasionally, an extra bank holiday is granted, for example, on the Queen’s Jubilee.

UK bank holidays occur on New Year’s Day, Good Friday, Easter Monday, Christmas Day and Boxing Day, early May bank holiday, spring bank holiday, and summer bank holiday.

According to gov.uk a bank holiday that falls on a weekend isn’t lost. Instead, a ‘substitute’ weekday becomes a bank holiday, normally on the following Monday.

Casual Leave

This term is not commonly used in the UK. In other countries, casual leave is a general term including all holidays or annual leave, other than mandatory/legally-defined or statutory leave.

Compassionate Leave (Bereavement Leave)

When someone close to an employee dies, they are entitled to ‘a reasonable amount’ of leave. The rules are generally murky, however, an employee who has lost a child is entitled to two weeks of statutory parental bereavement leave.

You can give more compassionate leave, if you choose, as long as you let your employee return to their job after taking compassionate leave. Helping them with a phased return to work can also ease them back into their job after a trauma.

Some employers allow their staff to take a duvet day to rest and recuperate when they need it most. Unlike other types of holidays that have to be agreed upon in advance, duvet days form part of an annual holiday allowance but can be taken whenever an employee chooses.

Gardening Leave

Someone who resigns, quits, or is asked to leave, might be paid garden leave when an employer doesn’t want or doesn’t need the employee to return to the office. It’s often used when people leave to work for a competitor or there are privacy or security concerns if they continue having access to the company’s systems or offices.

Maternity Leave (Parental Leave)

Mothers are required to take four weeks’ leave after their baby is born. Beyond that, maternity or shared parental leave can last up to one year but is paid differently for the first 26 weeks and the second 26 weeks. Keep in mind, though, that there are other legal requirements (including notice periods) and employee rights at play.

Paid Time Off (PTO)

Two types of leave, vacation, or time off of work are available: paid and unpaid time off. Workers are legally entitled to paid time off and HR should document this in a paid time off policy to clarify when people can take time off, how much they can take, and under what circumstances.

Sabbatical Leave

Also known as ‘long leave’ or ‘career break’, a sabbatical is granted when employees take extended time off work but can return to their job once they’re done. Sabbaticals can be paid or unpaid. Ultimately, allowing sabbaticals (or developing a policy around them) can mean a boost for your organisation.

Unwell employees are permitted to take paid sick leave in the UK. Generous leave policies may allow employees to take more time off when they’re sick, but every employee must be paid at least the minimum Statutory Sick Pay (SSP) amount if they have been sick for more than three days.

Time Off In Lieu (TOIL) Leave

Giving people time off for extra work that they’ve done (above their contracted hours) is called time off in lieu (or TOIL). Some employers provide TOIL instead of paying more for overtime.

Unpaid Leave

Employees can take unpaid leave, which can be deducted from their salary if they have run out of other types of leave. Employees might take unpaid leave to study, attend a medical appointment, undergo training, do jury service, or simply because they request (and the company/manager) agrees to it.

Miscellaneous Leave

Employers must allow their employees time off work to attend jury service or work as a voluntary magistrate. You can decide whether this is paid or unpaid (but make sure this is covered in every employee’s contract of employment ).

Understanding Assignments

What this handout is about.

The first step in any successful college writing venture is reading the assignment. While this sounds like a simple task, it can be a tough one. This handout will help you unravel your assignment and begin to craft an effective response. Much of the following advice will involve translating typical assignment terms and practices into meaningful clues to the type of writing your instructor expects. See our short video for more tips.

Basic beginnings

Regardless of the assignment, department, or instructor, adopting these two habits will serve you well :

  • Read the assignment carefully as soon as you receive it. Do not put this task off—reading the assignment at the beginning will save you time, stress, and problems later. An assignment can look pretty straightforward at first, particularly if the instructor has provided lots of information. That does not mean it will not take time and effort to complete; you may even have to learn a new skill to complete the assignment.
  • Ask the instructor about anything you do not understand. Do not hesitate to approach your instructor. Instructors would prefer to set you straight before you hand the paper in. That’s also when you will find their feedback most useful.

Assignment formats

Many assignments follow a basic format. Assignments often begin with an overview of the topic, include a central verb or verbs that describe the task, and offer some additional suggestions, questions, or prompts to get you started.

An Overview of Some Kind

The instructor might set the stage with some general discussion of the subject of the assignment, introduce the topic, or remind you of something pertinent that you have discussed in class. For example:

“Throughout history, gerbils have played a key role in politics,” or “In the last few weeks of class, we have focused on the evening wear of the housefly …”

The Task of the Assignment

Pay attention; this part tells you what to do when you write the paper. Look for the key verb or verbs in the sentence. Words like analyze, summarize, or compare direct you to think about your topic in a certain way. Also pay attention to words such as how, what, when, where, and why; these words guide your attention toward specific information. (See the section in this handout titled “Key Terms” for more information.)

“Analyze the effect that gerbils had on the Russian Revolution”, or “Suggest an interpretation of housefly undergarments that differs from Darwin’s.”

Additional Material to Think about

Here you will find some questions to use as springboards as you begin to think about the topic. Instructors usually include these questions as suggestions rather than requirements. Do not feel compelled to answer every question unless the instructor asks you to do so. Pay attention to the order of the questions. Sometimes they suggest the thinking process your instructor imagines you will need to follow to begin thinking about the topic.

“You may wish to consider the differing views held by Communist gerbils vs. Monarchist gerbils, or Can there be such a thing as ‘the housefly garment industry’ or is it just a home-based craft?”

These are the instructor’s comments about writing expectations:

“Be concise”, “Write effectively”, or “Argue furiously.”

Technical Details

These instructions usually indicate format rules or guidelines.

“Your paper must be typed in Palatino font on gray paper and must not exceed 600 pages. It is due on the anniversary of Mao Tse-tung’s death.”

The assignment’s parts may not appear in exactly this order, and each part may be very long or really short. Nonetheless, being aware of this standard pattern can help you understand what your instructor wants you to do.

Interpreting the assignment

Ask yourself a few basic questions as you read and jot down the answers on the assignment sheet:

Why did your instructor ask you to do this particular task?

Who is your audience.

  • What kind of evidence do you need to support your ideas?

What kind of writing style is acceptable?

  • What are the absolute rules of the paper?

Try to look at the question from the point of view of the instructor. Recognize that your instructor has a reason for giving you this assignment and for giving it to you at a particular point in the semester. In every assignment, the instructor has a challenge for you. This challenge could be anything from demonstrating an ability to think clearly to demonstrating an ability to use the library. See the assignment not as a vague suggestion of what to do but as an opportunity to show that you can handle the course material as directed. Paper assignments give you more than a topic to discuss—they ask you to do something with the topic. Keep reminding yourself of that. Be careful to avoid the other extreme as well: do not read more into the assignment than what is there.

Of course, your instructor has given you an assignment so that they will be able to assess your understanding of the course material and give you an appropriate grade. But there is more to it than that. Your instructor has tried to design a learning experience of some kind. Your instructor wants you to think about something in a particular way for a particular reason. If you read the course description at the beginning of your syllabus, review the assigned readings, and consider the assignment itself, you may begin to see the plan, purpose, or approach to the subject matter that your instructor has created for you. Given your instructor’s efforts, it helps to answer the question: What is my purpose in completing this assignment? Is it to gather research from a variety of outside sources and present a coherent picture? Is it to take material I have been learning in class and apply it to a new situation? Is it to prove a point one way or another? Key words from the assignment can help you figure this out. Look for key terms in the form of active verbs that tell you what to do.

Key Terms: Finding Those Active Verbs

Here are some common key words and definitions to help you think about assignment terms:

Information words Ask you to demonstrate what you know about the subject, such as who, what, when, where, how, and why.

  • define —give the subject’s meaning (according to someone or something). Sometimes you have to give more than one view on the subject’s meaning
  • describe —provide details about the subject by answering question words (such as who, what, when, where, how, and why); you might also give details related to the five senses (what you see, hear, feel, taste, and smell)
  • explain —give reasons why or examples of how something happened
  • illustrate —give descriptive examples of the subject and show how each is connected with the subject
  • summarize —briefly list the important ideas you learned about the subject
  • trace —outline how something has changed or developed from an earlier time to its current form
  • research —gather material from outside sources about the subject, often with the implication or requirement that you will analyze what you have found

Relation words Ask you to demonstrate how things are connected.

  • compare —show how two or more things are similar (and, sometimes, different)
  • contrast —show how two or more things are dissimilar
  • apply—use details that you’ve been given to demonstrate how an idea, theory, or concept works in a particular situation
  • cause —show how one event or series of events made something else happen
  • relate —show or describe the connections between things

Interpretation words Ask you to defend ideas of your own about the subject. Do not see these words as requesting opinion alone (unless the assignment specifically says so), but as requiring opinion that is supported by concrete evidence. Remember examples, principles, definitions, or concepts from class or research and use them in your interpretation.

  • assess —summarize your opinion of the subject and measure it against something
  • prove, justify —give reasons or examples to demonstrate how or why something is the truth
  • evaluate, respond —state your opinion of the subject as good, bad, or some combination of the two, with examples and reasons
  • support —give reasons or evidence for something you believe (be sure to state clearly what it is that you believe)
  • synthesize —put two or more things together that have not been put together in class or in your readings before; do not just summarize one and then the other and say that they are similar or different—you must provide a reason for putting them together that runs all the way through the paper
  • analyze —determine how individual parts create or relate to the whole, figure out how something works, what it might mean, or why it is important
  • argue —take a side and defend it with evidence against the other side

More Clues to Your Purpose As you read the assignment, think about what the teacher does in class:

  • What kinds of textbooks or coursepack did your instructor choose for the course—ones that provide background information, explain theories or perspectives, or argue a point of view?
  • In lecture, does your instructor ask your opinion, try to prove their point of view, or use keywords that show up again in the assignment?
  • What kinds of assignments are typical in this discipline? Social science classes often expect more research. Humanities classes thrive on interpretation and analysis.
  • How do the assignments, readings, and lectures work together in the course? Instructors spend time designing courses, sometimes even arguing with their peers about the most effective course materials. Figuring out the overall design to the course will help you understand what each assignment is meant to achieve.

Now, what about your reader? Most undergraduates think of their audience as the instructor. True, your instructor is a good person to keep in mind as you write. But for the purposes of a good paper, think of your audience as someone like your roommate: smart enough to understand a clear, logical argument, but not someone who already knows exactly what is going on in your particular paper. Remember, even if the instructor knows everything there is to know about your paper topic, they still have to read your paper and assess your understanding. In other words, teach the material to your reader.

Aiming a paper at your audience happens in two ways: you make decisions about the tone and the level of information you want to convey.

  • Tone means the “voice” of your paper. Should you be chatty, formal, or objective? Usually you will find some happy medium—you do not want to alienate your reader by sounding condescending or superior, but you do not want to, um, like, totally wig on the man, you know? Eschew ostentatious erudition: some students think the way to sound academic is to use big words. Be careful—you can sound ridiculous, especially if you use the wrong big words.
  • The level of information you use depends on who you think your audience is. If you imagine your audience as your instructor and they already know everything you have to say, you may find yourself leaving out key information that can cause your argument to be unconvincing and illogical. But you do not have to explain every single word or issue. If you are telling your roommate what happened on your favorite science fiction TV show last night, you do not say, “First a dark-haired white man of average height, wearing a suit and carrying a flashlight, walked into the room. Then a purple alien with fifteen arms and at least three eyes turned around. Then the man smiled slightly. In the background, you could hear a clock ticking. The room was fairly dark and had at least two windows that I saw.” You also do not say, “This guy found some aliens. The end.” Find some balance of useful details that support your main point.

The Grim Truth

With a few exceptions (including some lab and ethnography reports), you are probably being asked to make an argument. You must convince your audience. It is easy to forget this aim when you are researching and writing; as you become involved in your subject matter, you may become enmeshed in the details and focus on learning or simply telling the information you have found. You need to do more than just repeat what you have read. Your writing should have a point, and you should be able to say it in a sentence. Sometimes instructors call this sentence a “thesis” or a “claim.”

So, if your instructor tells you to write about some aspect of oral hygiene, you do not want to just list: “First, you brush your teeth with a soft brush and some peanut butter. Then, you floss with unwaxed, bologna-flavored string. Finally, gargle with bourbon.” Instead, you could say, “Of all the oral cleaning methods, sandblasting removes the most plaque. Therefore it should be recommended by the American Dental Association.” Or, “From an aesthetic perspective, moldy teeth can be quite charming. However, their joys are short-lived.”

Convincing the reader of your argument is the goal of academic writing. It doesn’t have to say “argument” anywhere in the assignment for you to need one. Look at the assignment and think about what kind of argument you could make about it instead of just seeing it as a checklist of information you have to present. What kind of evidence do you need?

There are many kinds of evidence, and what type of evidence will work for your assignment can depend on several factors–the discipline, the parameters of the assignment, and your instructor’s preference. Should you use statistics? Historical examples? Do you need to conduct your own experiment? Can you rely on personal experience? See our handout on evidence for suggestions on how to use evidence appropriately.

Make sure you are clear about this part of the assignment, because your use of evidence will be crucial in writing a successful paper. You are not just learning how to argue; you are learning how to argue with specific types of materials and ideas. Ask your instructor what counts as acceptable evidence. You can also ask a librarian for help. No matter what kind of evidence you use, be sure to cite it correctly—see the UNC Libraries citation tutorial .

You cannot always tell from the assignment just what sort of writing style your instructor expects. The instructor may be really laid back in class but still expect you to sound formal in writing. Or the instructor may be fairly formal in class and ask you to write a reflection paper where you need to use “I” and speak from your own experience.

Try to avoid false associations of a particular field with a style (“art historians like wacky creativity,” or “political scientists are boring and just give facts”) and look instead to the types of readings you have been given in class. No one expects you to write like Plato—just use the readings as a guide for what is standard or preferable to your instructor. When in doubt, ask your instructor about the level of formality they expect.

No matter what field you are writing for or what facts you are including, if you do not write so that your reader can understand your main idea, you have wasted your time. So make clarity your main goal. For specific help with style, see our handout on style .

Technical details about the assignment

The technical information you are given in an assignment always seems like the easy part. This section can actually give you lots of little hints about approaching the task. Find out if elements such as page length and citation format (see the UNC Libraries citation tutorial ) are negotiable. Some professors do not have strong preferences as long as you are consistent and fully answer the assignment. Some professors are very specific and will deduct big points for deviations.

Usually, the page length tells you something important: The instructor thinks the size of the paper is appropriate to the assignment’s parameters. In plain English, your instructor is telling you how many pages it should take for you to answer the question as fully as you are expected to. So if an assignment is two pages long, you cannot pad your paper with examples or reword your main idea several times. Hit your one point early, defend it with the clearest example, and finish quickly. If an assignment is ten pages long, you can be more complex in your main points and examples—and if you can only produce five pages for that assignment, you need to see someone for help—as soon as possible.

Tricks that don’t work

Your instructors are not fooled when you:

  • spend more time on the cover page than the essay —graphics, cool binders, and cute titles are no replacement for a well-written paper.
  • use huge fonts, wide margins, or extra spacing to pad the page length —these tricks are immediately obvious to the eye. Most instructors use the same word processor you do. They know what’s possible. Such tactics are especially damning when the instructor has a stack of 60 papers to grade and yours is the only one that low-flying airplane pilots could read.
  • use a paper from another class that covered “sort of similar” material . Again, the instructor has a particular task for you to fulfill in the assignment that usually relates to course material and lectures. Your other paper may not cover this material, and turning in the same paper for more than one course may constitute an Honor Code violation . Ask the instructor—it can’t hurt.
  • get all wacky and “creative” before you answer the question . Showing that you are able to think beyond the boundaries of a simple assignment can be good, but you must do what the assignment calls for first. Again, check with your instructor. A humorous tone can be refreshing for someone grading a stack of papers, but it will not get you a good grade if you have not fulfilled the task.

Critical reading of assignments leads to skills in other types of reading and writing. If you get good at figuring out what the real goals of assignments are, you are going to be better at understanding the goals of all of your classes and fields of study.

Many companies offer leave benefits that allow employees to take time off from work for various reasons. Leave benefits – whether paid, unpaid or partially paid – are generally an agreement between the employer and employee, or employees representative (such as a union).

Family and Medical Leave Act

The Family and Medical Leave Act provides certain employees with up to 12 weeks of unpaid, job-protected leave per year. It also requires that their group health benefits be maintained during the leave.

Fair Labor Standards Act

While certain types of leave are required by law, other types are voluntary incentives provided by employers. There is a common misconception that Department of Labor regulates leave benefits through the Fair Labor Standards Act . But, the FLSA only covers certain types of leave.

In fact, there are a number of employment practices which FLSA does not regulate. For example, it does not require:

  • Vacation, holiday, severance, or sick pay
  • Meal or rest periods, holidays off, or vacations
  • Premium pay for weekend or holiday work
  • Pay raises or fringe benefits
  • Discharge notice, reason for discharge, or immediate payment of final wages to terminated employees

A leave of absence is an extended period of unpaid leave an employer grants an employee for special reasons such as illness, bereavement, parental leave and more. In this article, we will discuss your obligations as an employer when an employee requests a leave of absence and how granting a leave of absence can work in your favor, when done for the right reasons, the right way.

A leave of absence is an extended time off from regular work, which is unpaid. Employees usually request a leave of absence to deal with any unusual circumstances such as the arrival of a new child, a medical emergency in the family, bereavement, sabbatical or finishing education.

Some of these conditions are covered under various federal or state laws and you must grant a leave of absence if all other criteria are met. However, for all the other situations, it is your discretion whether you grant the leave of absence or not.

Some laws that govern leave of absence include FMLA (Family and Medical Leave Act), EFMLA (Emergency Family and Medical Leave Act), ADA (Americans with Disabilities Act) and ADAAA (ADA Amendments Act).

Why Employees Request Leave of Absence

Every organization has paid time off provisions such as sick days, accrued vacation days, etc., for their employees, depending upon the type of employment and duration for which they have been working. Yet, there are instances when employees may need additional time after exhausting all their paid leave options . In such a situation, employees may request a leave of absence to ensure that they:

  • Keep their job while away
  • Avail other employment benefits such as health insurance coverage continuation for them and their family

Paid or Unpaid Leave of Absence?

A leave of absence is legally an unpaid time off. However, as an employer, you can choose to pay employees for their remaining paid leaves. But be sure to obtain legal counsel confirming if you are allowed to do that under the relevant laws. Alternatively, you can ask your employees to exhaust their paid leaves before requesting a leave of absence.

Sometimes an employer may put an employee on a paid leave of absence if they are part of some investigation. Or, as a perk, employees may be eligible for six weeks of paid parental leave after completing 12 months of service.

What Happens After Leave of Absence Ends

After the leave of absence period is over and the employee is back, you can choose to restore them to their former position or move them to an equivalent role. It really depends upon your leave of absence company policy. However, be sure to check state leave provisions before drafting your company policy.

There are two types of leaves of absence—mandatory and voluntary. Mandatory leave of absence is governed by federal, local and state laws such as FMLA and ADA. Be sure to check which laws apply to your organization and industry.

Voluntary leave is at the employer’s discretion and hence generally treated as an employee perk. You can advertise this as such while recruiting or engaging with employees.

Since voluntary leave is not covered by any laws, you must include company policies governing leaves of absence in the employee handbook to eliminate ambiguity. Be precise about who is eligible and who is not, and the policies governing eligibility.

What Is the Family and Medical Leave Act (FMLA)

The FMLA is a federal labor law that guarantees up to 12 weeks of unpaid leave during a period of 12 months for the following reasons:

  • Care for an ill family member
  • Parental leave in case of childbirth, adoption or foster care
  • Care for a covered service member with serious illness or injury
  • Military exigencies

Some non-FMLA medical leaves may still be covered under ADA provisions, so check all the rule books before making a decision.

FMLA eligibility criteria

You are required to consider leaves of absence under FMLA rules only if you have employed 50 or more employees for at least 20 weeks within a radius of 75 miles from your office over the current or previous year.

An employee who has been with you for the past 12 months and put in 1,250 hours of work is eligible to take a leave of absence.

Just so you know, all public agencies and local educational agencies are mandated to grant unpaid leave under FMLA.

Leaves of absence covered by federal, state or local laws that require you to reinstate the employee after their return are called protected leaves of absence.

Allowing your employees leaves of absence even for non-FMLA reasons shows your empathy. It may prove to be a differentiating factor for potential recruits when they consider you as an employer. It can prove beneficial in retaining existing employees, especially in the current wave of quiet quitting.

As an employer, you may choose to grant leaves of absence in other circumstances such as:

  • Finish higher education
  • Moving houses
  • Divorce, death or other family exigencies

Sometimes employees may request you to extend their leaves of absence due to extenuating circumstances. It is up to you to grant extensions if they have exhausted their legal leave entitlements.

While considering your options, it is best to take legal counsel first and then take note of industry best practices. Also, you should consult your HR to see how the decision to extend leaves of absence affects your business.

The electric carmaker Tesla is recalling more than 11,000 of its new Cybertruck vehicles after safety regulators found a potentially dangerous fault with its giant windscreen wiper. 

The US National Highway Traffic Safety Administration also said a trim in the boot may be improperly attached. 

"Excessive electrical current can cause the front windshield wiper motor controller to fail," the safety administration said in a recall acknowledgement letter. 

Tesla said it would replace the wiper motor at no cost to owners. 

It comes after nearly 4,000 Cybertrucks were recalled in April to fix an accelerator pedal pad that could come loose. 

Mass production of the vehicle, which starts at a price of $79,990 (£63,130), is expected to start next year. 

It's not yet known how many trucks have gone to consumers, but the Blade Runner-inspired car has been plagued by problems. 

Customers of both Tesco and OVO Energy are entitled to 2,500 free Clubcard points, the supermarket has announced.

The points can be redeemed as a £25 voucher or at double their value with Clubcard reward partners.

Customers can unlock the points by linking their accounts with both companies.

"The cost of living remains a key challenge for households and our partnership with Tesco is one of the many ways in which we are giving back to our customers with rewards that they can spend how they choose," said Mat Moakes, chief commercial officer at OVO.

New customers can link their Tesco Clubcard account when they sign up as an OVO customer, while existing OVO customers can log into their account, go to their profile, click "our partners", and select the Tesco Clubcard logo.

If you've been reassured by positive recent news on inflation and a widely-anticipated cut in interest rates later this year, unfortunately the Bank of England has a worrying update for mortgage payers.

About three million UK households are still set to witness hikes in their mortgage repayments over the next two years, the Bank has said.

Its Financial Policy Committee (FPC) added there are likely to be "very large increases" of more than 50% for the mortgages of around 400,000 households.

But the central bank stressed that UK lenders are still in a strong position to support households and businesses, even if the economic backdrop worsens.

The concerning update is in the Bank's latest Financial Stability Report.

It also showed that most households have already had an increase in their mortgage rates since borrowing costs began rising substantially in 2022.

Why is the outlook so bad if interest rates are expected to fall?

Interest rates are at a 16-year-high of 5.25%, with the central bank voting to maintain the figure for a seventh consecutive meeting earlier this month.

But many economists have predicted the base rate could be reduced at the Bank's next vote in August.

However, at the moment, around 35% of households with mortgages, or more than three million, are paying below 3% for a range of reasons - like existing deals which pre-dated the recent crisis - and are expected to see an increase between now and the end of 2026.

A typical household rolling off a fixed-rate mortgage before the end of 2026 is due to face a jump of around £180 a month, the report said.

It highlighted that an "increasing proportion" of households have been choosing to borrow over a longer period of time, reducing monthly repayments but leaving them with more debt to service over time.

Higher mortgage rates have resulted in many households and renters reducing their savings, the Bank also found.

PrettyLittleThing is facing more criticism after announcing it would issue refunds on delivery subscriptions for accounts it has banned for returning too many items.

The online fashion giant says it will refund outstanding gift cards and store credit, as well as £9.99 to closed accounts which had already purchased its royalty service entitling them to unlimited next day delivery for a year.

The company said: "We have noticed an extremely high returns rate from a small pool of customers who have demonstrated behaviours that were inconsistent with what we experience with the rest of our customer base.

"The actions taken are not designed to limit our customers who do need to return or deter them from returning, it was taken to address a small proportion of customers who have a high returns rate."

PrettyLittleThing added it does not plan to close any further accounts.

Some customers were not happy with the response, with one posting on X: "This is bullshit my last return was December 2023... and of course you turned off the comments."

Another wrote: "PrettyLittleThing expects us to order our clothes twice because their sizing is off and is closing people's accounts because of frequent returns. What a way to ruin your own business."

Analysts are crediting strong demand for technology-related stocks amid the rush for AI.

They also point to the growing hope among investors for a late summer/early autumn interest rate cut by the US central bank.

Amazon's shares ended the session on Wall St almost 4% up at $193 apiece.

The FTSE 100 has had a fairly muted start after falling almost 0.3% yesterday.

The index was one point up at 8,226 in early dealing.

In the wider market, Halfords stock was trading 6% lower.

The cycle sales and motor-focused retailer had earlier reported a fall in annual profits of almost a fifth and said that trading remained "soft".

The message to the market from Currys, the electricals chain, was more upbeat.

It revealed a 10% lift to its bottom line in the year to 27 April and said it was more confident about demand ahead.

Currys shares were 1% down, however, potentially reflecting concerns that its profit performance was not driven by higher sales.

More than half of councils are not confident their area is prepared to roll out the next phase of free childcare, a report has found.

From September, 15 hours of free childcare a week will be available to working parents of all children aged over nine months old - expanding the policy from working parents of two-year-olds.

But 59% of local authorities say they are unsure if they will have enough places, citing significant challenges in recruiting and retaining staff, according to research by Coram Family and Childcare.

"For this policy to be a success, it is essential that all families can take up their entitlements, and the next few months will be a crucial time in making sure they can," said Ellen Broome, managing director of Coram.

The childcare changes coming in September are the penultimate phase of a policy introduced by the chancellor at the budget last year.

In September 2025, all working parents of children aged over nine months olds will be eligible for 30 hours free childcare per week.

Coram found only 11% of councils were confident there will be enough places to meet demand - a figure almost unchanged since January.

At present, 52% of councils say all or almost all eligible parents seeking 15 hours of free childcare have been able to.

But Ms Broome added: "We are concerned there may be further issues not only this September, but further down the line for families in getting the childcare they need." 

Beyond workforce challenges, 36% of councils identified local buildings and space as barriers to delivering the service.

Martin Lewis has hit out at the Conservatives for using him in an attack ad.

The Tories posted a clip of the Money Saving Expert founder on X describing how a senior Labour member had told him they wanted to introduce a policy that was not in its manifesto.

Mr Lewis said the discussion he had been referring to was not about tax rises, but the Conservatives featured the video alongside the words: "They're not telling you the full truth. Labour have said they wouldn't put up your taxes. But it's now becoming clear that they have every intention to put them up."

Criticising the ad, Mr Lewis wrote: "NOWHERE in this comment do I talk about taxes.

"And the policy that I discussed (I will keep private as it was private) was NOT about taxes, or tax rises, it was about something that would be a positive change."

The Tories' original post was later tagged with a community note – a feature on X allowing readers to add context to a claim.

"Martin Lewis has confirmed that the policy he refers to in the video was not about taxes, and so is unrelated to the text it is presented alongside," the note read.

Labour, like the Tories, have promised not to increase income tax, national insurance or VAT during the next parliament.

Israel’s Supreme Court on Tuesday ruled that the military must begin drafting ultra-Orthodox Jewish men, a decision that threatened to split Prime Minister Benjamin Netanyahu’s coalition government amid the war in Gaza.

In a unanimous decision, a panel of nine judges held that there was no legal basis for the longstanding military exemption given to ultra-Orthodox religious students. Without a law distinguishing between seminarians and other men of draft age, the court ruled, the country’s mandatory draft laws must similarly apply to the ultra-Orthodox minority.

In a country where military service is compulsory for most Jewish Israelis, both men and women, the exemption for the ultra-Orthodox has long prompted resentment. But anger over the group’s special treatment has grown as the war in Gaza has stretched into its ninth month, requiring tens of thousands of reservists to serve multiple tours and costing the lives of hundreds of soldiers.

“These days, in the midst of a difficult war, the burden of that inequality is more acute than ever — and requires the advancement of a sustainable solution to this issue,” the Supreme Court said in its ruling.

The decision threatened to widen one of the most painful divisions in Israeli society, pitting secular Jews against the ultra-Orthodox, who say their religious study is as essential and protective as the military. It also exposed the fault lines in Mr. Netanyahu’s coalition, which depends on the support of two ultra-Orthodox parties that oppose their constituents’ conscription, even as other Israelis are killed and wounded in Gaza.

Israeli courts have ruled against the exemption before, including Supreme Court decisions in 1998, 2012 and 2017 . The top court has repeatedly warned the government that to continue the policy, it must be written into law — though that law would be subject to constitutional challenges, as previous ones were — while also giving the government time to hammer out legislation.
